Types of Injury Cases

Following is a brief list of the personal injury services provided.  The term “negligence” is commonly misunderstood.  It means a failure to use reasonable care under the circumstances.

Premises Liability:

When someone is injured on the premises of another there may be numerous theories by which the owner of the premises, the tenant, or even someone else may be liable.  These laws vary from state to state and are often changing.  It’s best to have each injury on someone else’s premises evaluated by a qualified attorney to determine if there is a viable basis for liability.

Motor Vehicle Injuries:

Most of the personal injuries suffered in the United States result from motor vehicle use.  These occur when the injured party is on sidewalks, crossing streets, in a motor vehicle, or on a bicycle.  They usually involve negligence of a driver, but sometimes may involve defective products or defective design of products, negligent maintenance of a vehicle, negligent vehicle repairs, or negligent highway or roadway maintenance or design.

Products Liability Injuries:

Products liability occurs when someone is injured as a result of defective design or manufacture of a product.  When defective design or manufacture is proven, liability is established for any injuries caused by the defective product.

On the Job Injuries (Workers Compensation):

On the job injuries automatically fall in the realm of the workers compensation laws.  That means that an injured party can only sue his employer under the workers compensation laws.  These laws require certain payment by the employer or its insurer, but limit recovery.

Often when an injury occurs on the job careful analysis can find other parties legally responsible for the injury which are not so limited in the nature and amount of recovery.
That is why its so important to begin the evaluation with an injury attorney such as M.W. Roth

Whether or not any other third parties can be determined to be legally responsible for the injury, we refer handling of the worker’s compensation claim to the attorney we believe to be among the best applicant’s attorneys in the State, and monitor the progress of your case and our client’s satisfaction.

Sports Injuries:

Injuries that occur during activities that bring with them risks inherent in the activity, such as participating in sports or attending athletic events or other events as spectators, are compensable when those risks are increased because of some person’s or some company’s negligence.

Healthcare (Medical) Malpractice

Unfortunately professional negligence by health care providers causes major injury and death to thousands of people in the US each year.  This is a sad fact, but true.  Most jurisdictions have legislated heavily in this area to protect and insulate healthcare providers and their insurers at the expense of those most seriously injured.  Anyone injured by a healthcare provider must have the case reviewed by a qualified medical malpractice lawyer to evaluate and advise.
